A Contact7 investigation found that in the state of Colorado, hundreds of sex offenders are getting off the sex offender registry every year. In one case, a felony sex offender's motion was granted even after his victim pleaded against it.

    violent rape
    child molestation
    but equally to:
    public urination
    sexting
    mooning
    streaking
    downloading suggestive or abusive images of those purported to be under the legal age
    sex with underage partner romeo & juliet scenarios where one of the partners aged into an illegal situation.
    those manipulated by law enforcement personnel inbait-and-switch sting operations
    false accusations of rape or abuse
    those who were lied to by underage female partners (note: this is not a legal defense in most states)

    @gewgulkansuhckitt90864 years ago So is the loophole that anyone is ever able to get off the sex offender registry? Because i could imagine if somewhere down the line you were proved innocent or is the loophole the manner in which this particular guy finagled the law?
    i don' t think this story makes the details clear enough. Obviously this particular example is really, really bad. But i don' t think the lawmakers were complete idiots who set out to allow any sex offender who so desired to get their names off the registry - especially not offenders like this guy. What did they actually intend for this law to pertain to?
    if the video gave us the information we needed then we could decide that they should (a) completely abolish the law or (b) fix the law so it works as intended

    @SeanHendy7 months ago I' m not sure that calling it ais an accurate description. The issue appears to be that the terms of the registry requirements, for an attempted offence, are less than for being convicted of the full offence. As a comparison, under uk law, there is law (the criminal attempts act) which basically provides that they will be tried for the full offence, with the potential sentences the full offence brings, i. E. No reduction, just because they didn' t complete the criminal act.
    however, this report is built on the presumption that everyone should be on the register for life, which in itself is an issue of contention.
    in this particular case, given the age of the perpetrator at the time, and the age of the victim at the time, you would grade this in a higher category. The mistake in the system is that he should have been offered any deal for pleading to a lesser offence ofbut it' s difficult to be specific without knowing the full details of the case and exactly what evidence was available.
    the responsibility lies squarely with the prosecutors in doing the deal they did.
    if the person did indeed commit r4pe of someone underage, i find it very strange that this could be reduced to anoffence. You would usually expect any reduction to be to s3xual assault, i. E. A complete offence, not an attempted offence. But then that' s the american judicial system for you. It often doesn' t make sense

    @kurochi47684 years ago You know what, i' m going to say it. I' m happy as hell for this guy. He has made a heinous act in his past, but he has tread onward from it and he is moving on with his life, while the woman is continuing to be a victim. My mother was molested as a child, and she uses it as an excuse for abandoning me and my siblings. I' ve been abused and i know the effects it had on me, but i do not call myself a victim.

The killer gets out and lives on one side of you. The rapist lives on the other side of you. Difference is you dont know that the killer is next door. Her response w/ the added eye contact and boosted animation was the worst act id="hidden17"ing ever. He was wrong and took advantage of his position but seems to have turned it around.     maybe if they had done their job we wouldnt have this problem. Maybe if the da stopped suc i have a friend; when she was in her 20s she got arrested for shagging her boyfriend in a public park late at night. No children present. She is now a sex criminal, but her name doesnt deserve to be on the same list as this guy. It doesnt deserve to be on any list.
    what the hell do you think kids do at make out point? Just make out? Get real.
    is the registry part of a punishment? Or is it a tool intended to help the public stay safe?
    sex offenders have lowest rate of recidivism of all criminal types. We have to ask ourselves; if we are trying to correct the offenders behaviour or are we trying to punish them, for life?
    are they likely to offend again? If the answer is a, no, then we need to give people a way off the registry.
    for if we do not give people a path to a fulla path to become full productive member of society, why would they ever attempt the journey?
    for what its worth:
    punitive action categorically cannot prevent crime. As it can only be applied to criminals after of the crime has been committed.
